Miami, FL- Reports surfaced Thursday alleging San Francisco 49ers’ Colin Kaepernick and was being charged with sexual assault after an April 1st incident at a friend’s apartment.
Kaepernick took issue with the initial report originating from the masters of gossip TMZ, who said Miami police were investigating a “sexual assault.” On his Twitter account, Kaepernick said TMZ’s report was “completely wrong” and skewered them for making things up.
He said: “They make things up about me that never happened. I take great pride in who I am and what I do, but I guess sometimes you have to deal with someone who makes things up. I want to thank all of the people who have shared their encouraging sentiments. I assure you that your faith is not misplaced.”
After the reports made the media rounds Miami police issued a statement, clarifying that neither Kaepernick nor two other NFL players– fellow 49er Quinton Patton, and Ricado Lockette of the Seattle Seahawks– named in the report are being investigated for a “suspicious incident.” The report does not specifically state the investigation is for a sexual assault.
The police report, which was obtained by several media outlets, details the accusations:
In the report the woman states that the group which included Kaepernick and other NFL players were drinking at one of player’s Miami apartment. The report states “they told her in order to drink the shots she had to ‘hit’ the bong which contained marijuana.”
The accuser told police she became “lightheaded and went to a bedroom to lay down.” After she removed her jacket and jewelry when Kaepernick “came behind her” followed her into the bedroom and “started kissing her.”
She said “Mr. Kaepernick started to undressed [sic] her” and she disrobed completely.
At that point Kaepernick left the room she said “they did not have sex.” After Kapernick exited the room, the woman claims Patton and Lockette “peeked” into the room and she yelled “What are you doing? Where’s Colin? Get out!”
The woman told police the two men then closed the bedroom door but she has no memory of whether something happened after that. She told police she woke up in a hospital bed and has no recollection of how she got there.
The woman acknowledged to police that she had a previous sexual relationship with Kaepernick.
In a statement the 49ers acknowledged the allegations and were gathering information but had no furthers comments about the incident.
It’s unclear if the allegations are true, that’s something only time will tell, but police have an obligation to investigate such claims.
There are times when athletes face false sexual assault and harassment allegations. We are not implying whether this is true or not in this particular incident, but it does happen. And when it does it is bad for the accused, and it is also bad for legitimate victims of sexual harassment and assault. Falsely accusing someone of inappropriate sexual behavior whether they are a famous athlete or a boss makes it harder for victims who truly face this type of abuse to have their allegations taken seriously.
