San Diego, CA– While there are thousands of legitimate claims of sexual harassment filed each year, there are occasions where people falsely accuse a coworker or boss to damage their reputation. That appears to be the case of California Republican Carl DeMaio whose former aide admitted to falsely accusing his former boss of sexual harassment.

DeMaio, who is openly gay, lost his Congressional bid last fall after his aide, Todd Bosnich, accused him of sexual harassment and retaliation. Now Bosnich admits to fabricating the harassment.

Bosnich claimed that he quit working for the Councilman because of his alleged sexual misconduct and accused DeMaio of offering him money to keep silent.

Fox News reports that Bosnich admitted in federal court today that he made up an email in which he alleged DeMaio threatened professional retaliation if Bosnich reported the harassment. Bosnich told a federal judge that he sent the email under a fake account and passed it off as one sent by DeMaio.

Throughout the ordeal, DeMaio repeatedly denied the allegations, but they nevertheless impacted his campaign a point DeMaio made when he lost the election by a narrow margin.

The Los Angeles Times reports that Bosnich entered a deal in which he pleaded guilty to obstruction of justice. Although he could face up to 20 years in jail, the Times reports that the federal prosecutor for his case will not ask the judge for jail time.

In a statement after Bosnich’s plea was announced, DeMaio said, “Bosnich’s lies were incredibly painful, smeared my reputation and derailed our congressional campaign…. I also want to thank the thousands of supporters who stood by me and saw this disgusting smear for what it was.”

If you have been falsely accused of sexual harassment, USAttorneys recommend you speak with a sexual harassment attorney near you to help you prove your innocence. They can guide through the investigative process and give important advice you need to clear your name.

There is no hard data on how many false claims of sexual harassment or workplace discrimination are filed each year. But that doesn’t change the fact that many claims of workplace discrimination and hostile environment are legitimate and are largely underreported.

People who file false sexual harassment claims harm the people they are accusing, as DeMaio’s misfortune clearly demonstrates. But they are not to the only victims of false accusations, their lies affect legitimate victims of sexual harassment by trivializing the issue. Sexual harassment victims fight an uphill battle trying to convince their employers that they are being subjected to the abusive behavior without others making false accusations. False claims only serve to further the perception that many sexual harassment complaints are frivolous and unfounded.

Our sexual harassment attorneys know how much the misconduct can affect a person emotionally and financially. They will work tirelessly to prove your claims so that you get the compensation you deserve.
