New York, NY- Court documents in the sexual harassment case against Nesim Zuberi, banquet supervisor for the famed New York Athletic Club, revealed that he requested sex from female employees in exchange for good shifts. Zuberi even admitted that he kept pornographic pictures of female employees on his computer.

In late fall of last year, the elite club in Manhattan was hit with a sexual harassment lawsuit after waitress Keisi Ballenilla said she endured five years of Zuberi’s inappropriate behavior. Ballenilla’s explosive testimony alleges that Zuberi coerced female employees into having sex with him and cajoled them into participating in “late-night orgies” in exchange for giving them high paying shifts and days off, according to the New York Post.

Ballenilla also alleged that racial discrimination was also prevalent at the club and they never did anything to stop either the sexual harassment or the racial discrimination.

According to Ballenilla’s testimony in a deposition given earlier this year, Zuberi coerced at least five female employees into sexually pleasuring him so they could obtain better paying shifts or get requested days off.

Ballenilla  alleges that Zuberi asked her to have sex with him on the pool tables on the club’s 10th floor. She also alleges he continued to request sex even when she was pregnant with her boyfriend’s child.

Testimony from other employees partially corroborates Ballenilla’s claims, but the attorney representing the club denies the claims stating their “exhaustive investigation” found that her claims were “without merit.”

Additional testimony from Zuberi, also revealed that he kept photos of his sexual encounters with Ballenilla and other female employees on his work computer and showed coworkers the racy photos. Many of those photos were of Ballenilla, but also included were photos of Zuberi having a threesome with his wife and a “Russian girl.”

The photos were taken late at night in the club during the numerous booze-driven orgies that took place in the swanky club’s banquet hall.

Ballenilla confirmed that she was in the photos and that she was forced to pose for them in order to keep her job.

“He wanted me to get the picture with the G-string,” Ballenilla, said according to the court documents obtained by the New York Post. “One day, he wanted to photograph my breasts,” Ballenia testified, adding later, “He made me do it. Otherwise, he would not give me jobs.”

Ballenilla’s legal team insists the club became aware of the photos two years ago, affirming that the New York Athletic Club was aware of the Zuberi’s misconducted, but took no steps to stop it.

The act of coercing a subordinate employee into engaging in sexual favors in order to keep their jobs or obtain promotions and pay raises is called quid pro quo harassment.
